The Internet webpage www.vitabooking.com is the property of "HEALTH BOOKING LTD", a company located in Nicosia Cyprus, legally represented and hereinafter referred to as The Company.The general terms of use herewith define the legally binding terms of use of the services we provide. If you do not accept the terms herewith, we ask you to leave the webpage and stop using our services. Upon access, browsing and use of our webpage's services, you accept and confirm that you have read, understood and agreed with the terms and conditions below (including the declaration of personal data protection).

 

1.Concepts/Definitions

 

In order for you to better understand the webpage's terms of use and the method of use of our services, we cite the following definitions:

- The term "Company" refers to the company titled HTB HEALTH TOURISM BOOKING LTD, a limited liability company which is subject to Cypriot law and its registered office address is 11 Akropoleos Street, Kaimakli, Nicosia, Cyprus.

- The term "Service" refers to the option for online booking of medical and healthcare services by private providers of primary, secondary and tertiary healthcare to patients abroad, as well as booking of other travel services offered in combination, for the user's benefit and facilitation.

- The term "Health Provider" refers to the medical or healthcare service provider, namely a private provider of primary, secondary and tertiary healthcare to patients.

- The term "Medical package" refers to a package of medical/healthcare services provided on the Platform for booking, which includes the main offered medical services and their cost.

- The term "Third Party Provider" refers to the provider of other travel services, namely the accommodation, ticket provider, of a product/service that is associated with tourism and is offered in combination or not with the medical/healthcare service, for online booking through the Platform.

- The term "Users" refers to users that obtain access to the webpage and use its services for online booking of medical packages and other travel services.

- The term "Offers" refers to the special terms and conditions defined for the services of the Healthcare Provider and third party providers on the webpage.

 

2. Objective of the services provided

 

The webpage, http://www.vitabooking.com, has been created by and is the property of the Company, which is the sole and principle holder of the content inserted in the platform, having secured the necessary license to use the information uploaded on it by the Providers.

The platform has been created and functions with the purpose to provide on behalf of the Company to the users the following services:

- Provision of information and user update on provided medical and healthcare services by primary, secondary and tertiary healthcare providers, as well as their cost.

- The option to book online medical packages and services on specific dates, under the condition the request is approved by the Healthcare Provider and in accordance with the procedure that is described in detail herewith:

"Booking a medical package:

 The users, after browsing and learning about the offered medical packages, will be able to make online bookings for their desirable date, submitting their request and personal details. The Healthcare Provider will immediately receive the patient's booking request through vitabooking, will confirm its availability for the specified date and will ask for the patient's medical file electronically, in order to approve the feasibility to provide the requested medical or healthcare service. An as comprehensive as possible a medical file of the potential patient will be requested and sent via e-mail through the platform, and a reservation will be expressed in the event that the file is missing information that could possibly prove essential for the appropriate handling of each incident.

If the Healthcare Provider, after examining the patient's file, approves the request for a specific medical service, the Provider will send through the platform the request's approval and the accurate costing of the proposed services. An explicit reservation should be expressed, moreover, regarding the expenses likely to arise following the on-the-spot clinical examination, which were not possible to be foreseen. These additional expenses, if any, should be made known to the patient in a detailed and well-documented manner, without delay, in order to give the patient a chance to reject or accept them. It should also be made clear whether the treatment package includes the cost of the medication or other possibly required diagnostic examinations, scheduled or supplementary.

The patient, after approval of his request and if he agrees with the precise costing of the medical services after his medical file's assessment, will complete the booking and will submit his credit card's details, in order to be charged with the booking's down-payment, which is 20% of the cost of the agreed upon medical service. Furthermore, the patient's credit card will be bound as guarantee for the remaining 80% of the cost for the agreed upon medical service, until the final payment to the Healthcare Provider, which will be made in accordance with the terms of the specific Healthcare Provider that will be made known to the user..

The completion of the booking through the Company's webpage translates to a legally bounding contractual relationship between the patient and the Healthcare Provider. From the moment the booking is finalized, the Company functions solely as the mediator between patient and Provider, conveying the information of the finalized booking with its terms to the Healthcare Provider, and, via e-mail, the verification of the agreement and its terms on behalf of the Healthcare Provider.

In case the patient withdraws and the agreement for the provision of medical services is canceled before the defined date for the provision of the medical service, the guarantee amount (80% of the total medical service cost) is disengaged from the credit card and returned to the user; however, the 20% down-payment already charged for the provided services for the medical file's examination, the preparation of a medical report and the information and online booking through the platform, is not returned to the user».

- The provision of information and update to users about the offered travel services, for their facilitation during their necessary -for the receipt of the medical package- stay in the Healthcare Provider's country, like transfer services to/from various destinations worldwide, ticket availability, or/and vehicle availability, or accommodation and reservation and/or purchase of goods provided by Third Party Providers.

The transaction related to the booking and provision of the service and the selected good is completed among the user and the Third Party Provider, who ultimately provides it. Each user must be aware and implicitly accept the terms defined by any Third Party Provider about the provision of the service or supply of the good selected and received, and the users assumes the relevant responsibility.

The Company acts solely as the mediator for the provision of aforementioned services, displayed and served through the platform and provided by the Healthcare Provider or the affiliated Third Party Providers that are advertised and publicized on the platform. By making a booking through vitabooking.com, you enter into a contractual relationship (legally binding) with the Healthcare Provider whose medical package you chose to purchase. From the moment your booking is finalized, we act solely as the mediator between you and the Provider, conveying your booking details to the relevant Healthcare Provider (or Providers) and sending you a confirmation email on behalf of the Healthcare Provider (or Providers).

 During the provision of our services, the information we publicize are based on the information received by the Healthcare Providers and the Providers. For this reason, the Healthcare Providers and Providers assume the sole responsibility for the provision of said prices, availability and other information, which appear on our Platform. Despite the fact we spare no effort for the proper function of our Services, we can neither confirm nor guarantee that all information is accurate, comprehensive or correct, neither can we be held responsible for possible errors (including obvious and typographic errors) for interferences due to suspension of operation, Platform restoration, update or maintenance works, or any other cause) for inaccurate, misleading or false information. Each Healthcare Provider offering a medical package and each Provider bears responsibility at any given time for the accuracy, completeness and correctness of the (descriptive) information (including prices and availability) appearing on our Platform.

Our service is provided solely for private and not for commercial use. For this reason, you have no right to resale, direct link, use, copy, monitor (e.g., with spider or scrape programs), present, download or reproduce any content or information, software, tickets, products or services provided on our Platform for any commercial or competitive activity or purpose.

 

3. Access to use the webpage

 

 Our webpage functions as an online booking site for medical services and health tourism services. From the moment you register to the platform, providing a username and a password, you are solely responsible for maintaining the password's confidentiality. You accept to never use the account, username or password of a third party, as well as to not reveal your password to any third party. You are responsible for any action performed using your username and password. Consequently, do not communicate your username and password to third parties at any time. If you lose your password, you risk also losing control of your personal data and information you communicate on the webpage. If your password has leaked to third parties, you are required to change it immediately.

 

4. Collection, use and dissemination of information you provide

 

For the successful completion of the services' provision through the platform, it is necessary for the user to publicize information pertaining to himself or herself and may constitute personal data, which is collected and processed by the Company. Any user of the Platform and the services rendered through it gives his unreserved authorization to the Company to collect, use and convey to Third Party Providers the information needed for the services' provision, under the terms and conditions specified below. In case any user disagrees with the collection, use, process and/or transmittal of their personal data according to the terms herewith must refrain from using he services, otherwise it is inferred that the terms continue to be accepted by said user without reservation.

The Company informs you that the collected information will be subject to processing, primarily in order to provide the aforementioned services, for satisfying your needs or communicating with you for any issue related to the webpage's use.

Our services are addressed solely to individuals that have the legal capacity to enter into contracts according to the Greek Law. Our services are not addressed to minors, under 18 years of age, who are not entitled to and should not disseminate their personal data. It should be especially noted that the Company does not collect your credit card information, but each time you wish to complete a booking you are automatically transferred to the home webpage of the Data Process provider with which the Company has contracted for this purpose, namely ..................... and you insert your credit card information there.

The webpage uses cookies for recognizing repeated access to it. These are small text bits stored on each user's computer hard drive and they do not have access to any document of file on the computer. They are only used for the user's access facilitation to specific services and for statistical reasons. 7. Prices of Medical Packages - Method of Payment

 

The prices cited on the platform related to every offered medical package constitute the total cost to purchase the specific service, the total corresponding taxes and fees, as well as any Company fee for the services provided through the platform that are applicable upon the completion of the booking, or otherwise upon completion of the transaction, with the reservation of any expenses probable to occur after the on-site clinical examination, which could not have been foreseen during the completion of the booking. These additional expenses, if any, should be made known to the patient in a detailed and well-documented manner, without delay, in order to give the patient a chance to reject or accept them. It should also be made clear whether the treatment package includes the cost of the medication or other possibly required diagnostic examinations, scheduled or supplementary.

The cost of each service offered through the Platform is specified by the corresponding Third Party Provider and is made known along with the applicable taxes and fees to vitabooking. The Company bears no responsibility whatsoever for the setting of prices and/or any changes to them.

The patient, after approval of his request and if he agrees with the precise costing of the medical services after his medical file's assessment, will complete the booking and will submit his credit card's details, in order to be charged with the booking's down-payment, which is 20% of the cost of the agreed upon medical service. Furthermore, the patient's credit card will be bound as guarantee for the remaining 80% of the cost for the agreed upon medical service, until the final payment to the Healthcare Provider, which will be made in accordance with the terms of the specific Healthcare Provider that will be made known to the user.

The credit card owner information is automatically conveyed to the affiliated Payment Service Provider that executes the transaction and charge of the credit card in case the total services are provided. Every user should use the credit card which they legally own and are authorized to use.

The Company is entitled to request at any given time, in the context of providing and charging services, the presentation by any user of any details deemed necessary (e.g. copy of ID or Password and/or of credit card, proof of residence address, etc.), in order to match the details of the service recipient with those of the used credit card, but also for any other reason deemed necessary by the Company in the context of providing the service.

Our service is offered free of charge, because as opposed to many other providers we will not charge you for our Service and we will not add extra expenses (of booking) to the price. For your information, the Healthcare Providers and Third Party Providers pay commission (a percentage of the medical package price) to the Company, after the final user uses the Provider's service or product.

 

8. Policy of Payment - Withdrawal

 

The prices of the medical packages offered through the Platform are highly competitive, as they are addressed to third-country citizens who will travel to Greece to receive the requested medical or healthcare service. Said prices (which include VAT and all other taxes) include the services described in detail in the offered medical package. Any extra costs that might occur after further medical examinations and/or examinations that are needed which are not described in the medical package, will burden the customer.

The payment and withdrawal policy depends on the payment policy of each Healthcare Provider and is described in detail in each medical package posted on the Platform. In any case, according to Law 2251/1994 on "Consumer Protection" as is applicable, and specifically the provisions on the conclusion of distance contracts (e.g., through the Internet) the User has the right to withdraw without giving any justification as per the provisions of Article 3e of Law 2251/1994, a right which is executed with the completion and submission to the Company of a written declaration of withdrawal within fourteen (14) calendar days since the day the contract was concluded.

In case the patient withdraws and cancels the agreement for medical services' provision before the defined date for the provision of the medical service, however, 14 days after its conclusion, the guarantee amount (80% of the total medical service cost) is disengaged from the credit card; however, the 20% down-payment already charged for the provided services for the medical file's examination, the preparation of a medical report and the information and online booking services is not returned to the user.

In certain cases, lower prices for a specific medical or other service are posted on the Platform, however these are defined by the Providers and might be accompanied by special limitations and terms, which pertain for example with cancellation and money return. You are requested to carefully examine the corresponding products, services, booking terms and information for such terms, before you proceed with your booking.

 

9. Payment of other travel Services, accommodation reservations and goods

 

The payment process is carried out securely and takes place via your debit/credit card or your bank account to the Provider's bank account, through a third party. Any payment we carry out on the Provider's behalf, which is transferred to the Provider, will constitute in any case payment of the whole (or part of) the booking price by you, or of the relevant product or service at the final settlement of the said (partial) owed and paid price, and you cannot claim anew the already paid amounts.

For certain (nonrefundable) prices or special offers, you are asked to take into consideration the possibility that the Providers will ask for a payment in advance, through wire transfer (if available) or through credit card, and consequently your credit card might be pre-approved or charged (in certain cases without the option for money return) during the completion of the booking. You are requested to carefully examine the details of the preferred product's or service's booking beforehand, in case such terms are applicable. The Company will not be held responsible for any (alleged) approved, non-approved or erroneous charge by the Provider and you cannot claim any amount for any valid or approved charge by the Provider (including prepaid prices, no-show and cancellation) to your credit card.

In case of fraud or non-authorized use of your credit card by third parties, most banks and credit card companies assume responsibility and cover all charges due to embezzlement or fraud, which sometimes are subject to deductible amounts (which is usually defined at EUR 50, or the local exchange equivalent). In case your credit card company or your bank charges you for the uncovered amount because of unauthorized transactions following booking through our Platform, we will cover this deductible amount up to the total of EUR 50 (or the local exchange equivalent). By booking a travel service with a Third Party Provider, you accept and agree to the relevant withdrawal and no-show policy of the specific Provider, as well as with any additional terms and conditions of the Provider, which might apply for your booking or during your stay. You are asked to bear in mind that for certain prices or special offers there is no cancellation or change option. The applicable municipal/tourist tax might be charged by the Provider in case of no-show or cancellation with charge. You are requested to check the (booking) information of the product or service carefully for such terms, before completing your booking.

The cancellation and prepayment policies differ, depending on the Third Party Provider. Please read the fine print carefully (at the bottom of each Provider's page on our site) as well as the important information when confirming your booking, for any additional policies the Provider might apply (e.g., pertaining to the visitors' age, cancellations/extra charges for group bookings, extra beds/breakfast charges, pets and credit cards). You assume the risk of delayed payments, wrong bank, erroneous debit/credit card information, invalid debit/credit cards or insufficient amounts, and you are not entitled to any return (of non-returnable) prepaid amount, unless the Provider agrees or allows something different, according to the policy of prepayment and cancellation they implement.

Each Third Party Provider is solely the competent one to define the option and process of booking cancellation or change, provision of goods they provide, according to the terms they set and publicize in relation to the goods they offer.

In case there is the option to cancel or change according to the Third Party Provider's terms, the user is informed and these terms are applied, in relation also to the amount that might be returned and the amount that might be withheld as cancellation fee. Additionally to this amount, the Company might charge, where appropriate, booking or good cancellation or change cost, as defined per product and posted on the platform.

 

10. Special Terms for Travel & Transport Services

 

The Company acts solely as mediator for the supply of the travel services posted and served through the Platform, provided by the provider of each good and/or third party services mediator, to be referred hereinafter "Third Party Provider", advertised and publicized on the Platform and according to the terms and conditions that he, the Third Party Provider that is, sets up and makes known to the users of the services/goods he supplies. The users of the services assume sole and whole responsibility for the obtainment and possession, before the commencement of their trip, of the suitable, valid and legal travel papers, as well as all other accompanying papers that might be requested (e.g., visa, passport, residence permit, etc.) in compliance with all applicable laws, regulations, directives and travel prerequisites of origin, destination or transfer countries, and for their full knowledge of the consequences non-compliance can incur to themselves or to third parties. The Company assumes no responsibility whatsoever for any direct, indirect, coincidental, specific, pecuniary or derived detriment occurs due to potential user inability to obtain the necessary travel documents. For this reason, users are recommended during their travel scheduling to have taken beforehand all necessary information regarding the terms and conditions that must be fulfilled for their trip, by the competent authorities (e.g., embassies, consulate, etc.).

 

11. The Company's Responsibility

 

The Company does not guarantee the correctness, accuracy and clarity of the information posted on the Platform, including prices and goods, given that this information is provided for publication by third parties, specifically by Third Party Providers, and its confirmation and/or control by the Company regarding the above is not and could not be feasible. For this reason, the Company assumes no responsibility whatsoever, but maintains its right to correct, update and/or alter in any way this information, if it is so requested by the information provider or after their consent, even in case the correction, update or alteration regards and/or affects pending bookings.

The Company does not guarantee nor does it assume any responsibility whatsoever related to the posted availability of goods provided, but publicizes the specific information on the Platform, as it is submitted by the Third Party Provider of each case.

The Company does not guarantee nor does it assume any responsibility for the adequacy, suitability, availability of goods provided by Third Party Providers, as well as for any actions or omissions from their part in the context of their cooperation with the Company and/or fulfillment of the provision to the users that are likely to raise compensation claims for any reason. In any case, the Company assumes no responsibility against the users or any third party for direct or indirect damages, loss of profits, loss of income or profit, loss of opportunity, loss or destruction of data, and overall any incidental and consequential damage which is due or pertains to the access and/or use of the Platform and the goods purchased through it.

For this reason, the users are requested in any case, before receiving any service through the Platform, to be informed about and, if necessary, to accept the amended terms anew.

The terms herewith are interpreted based on the Greek Law and the Courts of Law of Athens are deemed as the competent authorities to resolve disputes of any nature. In what regards the legal disputes that might arise between third parties and yourself, you are solely responsible, and the Company reserves the right to intervene if it deems it necessary for the protection of its rights and overall interests.

 

15. Communication

 

Communication, including any update necessary based on the terms within, among the Company and the Platform's users takes place legitimately mainly via electronic means of communication, specifically via the email address the user has submitted to the Company for this purpose.

Each user is requested to make known to the Company his real information, including a valid email address which he legitimately owns.

The means and method of communication of the user with Third Party Providers are defined by the users according to the terms and communication details they define and publicize. It should be noted that the reporting of erroneous, inaccurate and/or false communication information might lead to inability and/or denial to provide the selected service/good, without excluding further responsibility for compensation.
